The provisions applicable to any requested booking changes and cancellation of International Cruises are set out in the clauses 23 and 24 below. Refunds shall be made as specified herein or in terms of the Company’s refund policy, which remains subject to change from time to time at the sole discretion of the Company and without notice to you. 1.1 MSC Cruises (Australia) Pty Ltd, hereinafter referred to as the “Company”, provides a booking service for Passengers wishing to book a Holiday Package with MSC Cruises. All travel services featured in the Company’s brochure and/or in the Official Website are advertised for sale by MSC Cruises S.A. When we confirm your Booking, you will be entering into a Contract with MSC Cruises for the supply of each travel service to you. Since the Booking Terms & Conditions applicable to the single Cruise or Holiday Package are those in force at the time of completing the Booking, irrespective of those published in the relevant Company’s brochure, it is recommended to check with the Sales Agent or by visiting the Company’s Official website for the most up to date Booking Terms & Conditions.
Booking Procedure and Deposit

If one of the travelling minor’s parents is not cruising, a signed authorisation letter, made in accordance with the laws of the country where the minor resides, from the absent parent authorising the minor to travel has to be provided at the moment of Booking.
An original passenger must remain in the Booking for the name change not to be considered a cancellation. If an original passenger does not remain in the Booking, it will be considered a cancellation and is subject to the above cancellation charges. If you cancel your cruise, you’ll be given a refund for the unused portion of your cruise fare. The amount of your refund will depend on your cancellation policy and the time of your cancellation.
The Passenger must make sure that information which the Company holds about him/her is up to date and accurate. 26.2 The Company requires Personal Information including but without limitation to name, address, gender, citizenship and dietary requirements which may disclose a Passenger’s religious beliefs, any health, medical disability and any other special needs to process the Passenger’s booking effectively. 20.16 Any damages payable by the Company or MSC Cruises (for any reason) under the Contract shall be reduced in proportion to any contributory negligence by the Passenger (or the Agent, where applicable). 19.1 If a Passenger or his/her authorised representative has made a Booking directly with the Company, the Company will, on behalf of MSC Cruises, pay any applicable refund to the Passenger.

The third party shall be bound by these STCs including, any cancellation charges that may arise after transfer of the Cruise Booking. The supplementary levy is to be levied on any Passenger occupying the cabin for single use as a result of the cancellation or no- show of a co-Passenger (who was booked and confirmed to travel with them in the same cabin). Alternatively, should the remaining single Passenger opt to cancel the Booking, the latter will pay the cancellation charges in accordance with clauses 15 and 24 in addition to the insurance premium. 26.3 The Company may pass your and/or the Passenger’s Personal Information on to other relevant individuals such as Agents, hotels, airlines or other transport providers, security and/or credit verification companies, credit and debit card companies or any governmental or public authorities, either as required by law or regulation or, if required by other such bodies. The Company may also circulate a passenger list to all Passengers prior to the Cruise which will include the names and nationality of each passenger.
MSC may be required to pay the Service Providers in advance for the Additional Services which you have booked. By purchasing any Additional Services through MSC, you appoint MSC as your agent to arrange, book and collect payment for such Additional Services. In addition to your Cruise Ticket, you may wish to purchase Additional Services such as air tickets, hotel accommodation, Shore Excursions, concert tickets or tickets for other entertainment to be held on board, which Additional Services are provided by Service Providers. The Additional Services may be provided before, during and/or after your Cruise. I am still waiting on a cancelled excursion to be refunded but so far that has been the only financial hiccup that I have had with MSC...but others have not been so lucky.
The Company shall not be responsible for any liabilities arising in respect of flights or transfer arranged by the Passenger. 1.10 If you book a Cruise, purchase a Cruise Ticket and/or any Additional Services, through a Travel Agent, Group Organiser or Charterer (as defined in the relevant additions agreements relating thereto), you agree that the person or company acting as either, is not an agent of MSC. Accordingly, bookings and/or money handled by the Travel Agent, Group Organiser or Charterer is handled on your behalf and not on MSC’s behalf.

MSC cannot accept liability or pay compensation where performance (prompt or otherwise) is prevented or affected in these circumstances. 15.5 Subject to the provisions of clause 13, Cruise Bookings and Contracts of Carriage are non- transferable. Accordingly, name changes and Cruise date changes are typically considered cancellations and are subject to the above cancellation fees, unless permitted by MSC in its sole discretion and with good cause shown, as provided for in clause 13.
